1. Acceptance of Terms
By accessing or using the TSC Rewards website, platform, or services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services. These Terms apply to all visitors, users, brands, retailers, and other parties who access or use the Services.
2. Description of Services
TSC Rewards provides a platform connecting beverage brands, independent retailers, and consumers through in-store activations, loyalty programs, and consumer data services. Our Services include but are not limited to: activation campaign management, consumer engagement tools, rewards and loyalty infrastructure, data analytics and reporting, and marketing automation.
3. User Accounts
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password you use to access the Services and for any activities or actions under your account. You agree to notify us immediately of any unauthorized access to or use of your account.
4. Brand & Retailer Partnerships
Brands and retailers participating in TSC Rewards programs are subject to additional terms outlined in their respective partnership agreements. Activation campaigns, pricing, and service levels are governed by the specific tier and agreement executed between the partner and TSC Rewards. All campaign data, reporting, and deliverables are subject to the terms of the applicable partnership agreement.
5. Compliance with Alcohol Regulations
All activities conducted through the TSC Rewards platform comply with applicable federal, state, and local alcohol regulations. Alcohol service during in-store activations remains under the control of the licensed retailer. Tastings are free and voluntary, and purchases are never required for participation in the rewards program. Brand representatives act in an educational and marketing capacity only.
6. Intellectual Property
The Services and their original content, features, and functionality are and will remain the exclusive property of TSC Rewards and its licensors. The Services are protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of TSC Rewards.
7. Limitation of Liability
In no event shall TSC Rewards, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.
8. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after revisions become effective, you agree to be bound by the revised terms.
